Jason Cai, 53, a California software engineer is on trial for the second time, in the murder of Xia Zhao, a lawyer, who was representing the family of his deceased wife in a wrongful death suit against Cai. A previous trial, in 2010, ended in a jury hung 11-1, in favor of conviction. The prosecution argued that they have video footage of Cai running from the crime scene. The defense contends that the footage is of another person on a different date.
Cai is charged with murder while lying in wait and is accused of shooting Zhao on July 1, 2008 in the parking lot of her law office, the Mercury News reports.
In 2006, Cai was acquitted of murder for the 2003 death of his wife, who was found dead in the family’s swimming pool. Cai had taken out $250,000 in life insurance not long before her death.
