D.C. Appeals Court: It’s Going To Get Ugly’ Was Not A Threat of Physical Violence, Insubordination; Termination Not Warranted. (http://bit.ly/n7EUIa / @Legal_Times) (Two electricians at a job site were displeased over a break policy they thought was unfair. One man said things will “get ugly” if he were fired. The other told a supervisor he better “bring his gloves.” Both workers lost their jobs based on the company’s zero tolerance policy toward workplace violence. HELD: the firing of the two men was unlawful as “single, brief and spontaneous” utterances were not physical threats but vocal resistance). For full opinion see: United States Court of Appeals or Kiewit Power Constructors Co. v. NLRB.
